Terms of Use

These Terms of Use ("Terms") govern your access to and use of Rooflane Realty ("Rooflane", "we", "us") at https://rooflanerealty.com and related services. By using the platform, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the platform. These Terms constitute an electronic record and a binding agreement under the Indian Contract Act 1872 and the Information Technology Act 2000.

Rooflane is an intermediary that connects prospective buyers with RERA-registered developers and agents. We are not the seller, promoter, or developer of any property, and we are not a party to any transaction between you and a developer/agent. Listings are provided to help you discover and enquire about properties; any booking, agreement, or payment is between you and the relevant developer/agent.

You must be at least 18 years old and able to form a binding contract to use registered features. You are responsible for the accuracy of the information you provide, for keeping your account credentials secure, and for all activity under your account.

Property details, availability, pricing, EMI estimates, ready-reckoner figures, maps, and market data on the platform are indicative, may be provided by third parties (including developers), and are offered without warranty of accuracy, completeness, or fitness for a particular purpose. You must independently verify all details - including RERA registration, approvals, pricing, and specifications - with the developer/agent before making any decision. Nothing on the platform is an offer, investment advice, or a guarantee of any outcome.

When using the platform you must not, and must not permit others to: (a) upload, publish or transmit content that is unlawful, defamatory, obscene, misleading, or that infringes any third-party intellectual-property or other rights; (b) impersonate any person or misrepresent your affiliation; (c) upload malware or attempt to gain unauthorised access to, disrupt, scrape, or overload the platform or its systems; (d) use the platform for spam or unsolicited marketing; or (e) violate any applicable law, including IT Rules 2021 r.3(1)(b) and RERA advertising rules.

This Acceptable Use Policy is incorporated into, and additionally binds users of, our Developer Listing Agreement and Channel Partner Agreement. We may remove content and suspend accounts that breach it, and we operate a notice-and-takedown process (see Section 11).

If you submit content to the platform (for example, enquiry details, or - for developers/partners - project images, plans, brochures and text), you warrant that you own it or are licensed to submit it and that it does not infringe any third-party rights. You grant Rooflane a non-exclusive, royalty-free, worldwide licence to host, store, reproduce and display that content for the purpose of operating and marketing the platform and the relevant listing.

The Rooflane Realty name, logo, branding, site design, software, and all original content are the exclusive property of Rooflane Realty and are protected under the Copyright Act 1957 (ss. 17 & 30), the Trade Marks Act 1999, and applicable law.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to view and use the site for its intended purpose. You may not copy, reproduce, modify, distribute, scrape, or create derivative works from any part of the site or its assets without our prior written permission.

The platform uses third-party services, including Google Maps Platform APIs to display property locations and nearby places. By using features that rely on Google Maps, you agree to be bound by Google’s Terms of Service (including the Google Maps/Google Earth Additional Terms of Service) and acknowledge Google’s Privacy Policy. We are not responsible for third-party services or content, which are governed by their own terms.

The platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Rooflane disclaims all implied warranties and is not liable for any indirect, incidental, special, or consequential loss, or for any dealings between you and a developer/agent. Our aggregate liability arising from the platform shall not exceed the amount (if any) you paid us for the relevant service.

You agree to indemnify and hold Rooflane harmless from claims, losses and expenses arising out of your content, your use of the platform, or your breach of these Terms or applicable law.

We may suspend or terminate your access, and remove content, at any time for breach of these Terms or the Acceptable Use Policy, or where required by law. You may stop using the platform at any time and may delete your account from your profile settings.

For complaints, or to report content you believe is unlawful or infringing, contact our Grievance Officer (details below) or use our Grievance page at https://rooflanerealty.com/grievance. We acknowledge complaints within 24 hours, aim to resolve them within 15 days, and act on valid court/government removal orders within 36 hours, consistent with IT Rules 2021 r.3(2). This process helps preserve our safe-harbour as an intermediary under IT Act 2000 s.79.

These Terms are governed by the laws of India. Subject to any applicable consumer-protection rights, the courts at Mumbai/Thane, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the platform.

We may modify these Terms from time to time. The version and effective date are shown at the top of the page. Your continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
